Tuition
assistance recoupment
a.
Soldiers agree (10 USC 2005) to reimburse
the Army upon signing the DA Form 7597 when—
(1) The Soldier
withdraws because of official separation, confinement,
or similar administrative action by commanders for
disciplinary or fraudulent causes.
(2) The Soldier
withdraws from or does not complete a course for
personal reasons.
(3) The Soldier
receives a failing grade for academics.
(4) The Soldier
receives a failing grade for nonattendance.
(5) The Soldier
fails to make up an "incomplete" grade within the time
limits stipulated by the institution or 120 calendar
days after the completion of the class, whichever comes
first. ESO may extend the 120 days at their discretion
based on extenuating circumstances.
(6) A
commissioned officer or commissioned warrant officer
fails to fulfill the service obligation as noted in
paragraph 5–10a.
(7) eArmyU
program requirements are not met as stated in the DA
Form 7596.
b.
TA recoupment for unserved service
commitment is required when—
(1) A
commissioned officer or commissioned warrant officer
fails to complete the two-year service commitment (10
USC 2007).
(2) A RC
commissioned officer fails to complete at least four
years of Selected Reserve service from the date of
completion of the course for which TA was provided (10
USC 2007). RC officers who voluntarily separate or are
discharged for misconduct before they complete their
service obligation are required to reimburse the Army
the amount of TA representing the unserved portion of
the 4-year obligation (10 USC 2005).
(3) A Soldier
participating in eArmyU fails to complete the SRR as
specified in the DA Form 7596.
c.
TA recoupment is not required when—
(1) A Soldier
has resolved reimbursement of TA for course withdrawal
or incomplete.
(2) A Soldier
withdraws or does not complete a course for reasons
clearly beyond the individual’s control, such as
emergency leave/reassignment, illness/hospitalization,
or unanticipated military mission. Active duty Soldiers
will process military withdrawals through GoArmyEd.
However, these will be subject to verification upon
request. If requested to provide documentation
substantiating the military withdrawal, Soldiers will
obtain signed TA waiver documentation as outlined in
para 5–13c(2)(a). Soldiers are required to
withdraw when facing an academic failure. However,
Soldiers who fail for reasons previously outlined may
address pending recoupment as an exception through the
ESO/ESS. Exception decisions on TA recoupment do not
change the failing grade.
(a)
The Soldier is required to provide the
name and contact information of the unit commander and
the battalion commander or first lieutenant colonel in
the Soldier’s chain of command for the military
withdrawal in GoArmyEd. For the ARNG and USAR
Soldier, the commander or representative (E-7 or above)
is authorized to verify the reasons for withdrawal or
noncompletion.
(b)
TA waiver verification will include
written justification verifying why the Soldier was
unable to complete the course with specific dates the
Soldier was unable to attend class and that the reason
was unanticipated.

(c)
ESO will review the TA waiver
verification and ensure required information and valid
reasons are provided.
(d)
ESO will contact the unit commander or
unit administrator in the event the TA waiver
verification does not provide adequate or required
information.
(3) Death of a
Soldier occurs or Soldier is on the Wounded Warrior list
as verified by the Army Human Resources Command.
d.
TA recoupment—
(1) ESO will
establish an out processing system ensuring all Soldiers
will clear the AEC upon PCS or ETS/ retirement. All TA
obligations must be resolved and recoupment actions
initiated prior to clearing. If an active duty Soldier
does not out-process according to standing operating
procedures, AEC should audit the Soldier’s account and
proceed with any recoupment action after the Soldier has
ETS.
(2) RC ESOs
will coordinate with their respective G-1 to receive the
list of Soldiers to be discharged in the near future and
will audit the Soldier’s account and proceed with any
recoupment action necessary.
(3) ESO will
ensure separation documentation reflecting approval for
separation from Officers/Warrant Officers Branch is
received prior to processing recoupment for
noncompletion of an ADSO. The officer must have a CDR,
AHRC, AHRC–PDT–P message authorizing voluntary
separation. Once voluntary separation is approved and
proper documentation received, TA recoupment will take
place. The amount of TA to be recouped is determined by
dividing the amount of TA received by 24 months and
multiplying that figure by the number of months
representing the unserved portion of the ADSO. For
example, an officer received $300 in TA for a course but
is to depart the service 10 months before completion of
the 2-year service obligation. To calculate the
reimbursement owed, divide $300 by 24 months and
multiply times 10 months. The amount to be reimbursed is
$125.
(4) For the
active component, most recoupment's will be accomplished
through an electronic interface between GoArmyEd and the
Defense Finance and Accounting Service (DFAS). In those
cases where manual TA recoupment is necessary, it will
be processed as follows:
(a)
Complete DD Form 1131 (Cash Collection
Voucher) and submit money order or certified checks to
the local finance and accounting office (F&AO) to effect
cash recoupment.
(b)
Complete and submit DD Form 139 to the
local F&AO.
(c)
ESOs will follow up with their F&AO to
ensure recouped TA dollars are credited to the proper
VATA MDEP.
Army
National Guard FTA Policy
d.
Recoupment. Soldiers are
responsible for submitting grades within 30 days after
course completion. ESOs are responsible for verifying
the course completion status by receipt of an official
grade report. Those soldiers who receive a failing grade
or don’t complete the course will have their funding
recouped and future ARNG FTA is suspended, unless there
are extenuating circumstances due to no fault of the
soldier. In the case of centralized States, this
recoupment process will be facilitated by DANTES.
(1) ESOs will
recoup 100% of the ARNG FTA funds provided to soldiers
who are discharged prior to completing Initial Active
Duty for Training (IADT).
(2)
Commissioned officers who fail to complete the required
4 year obligation will be required to reimburse the
amount of TA according to the following formula; Amount
of TA divided by 48, multiplied by the remaining amount
of obligation. For example, an officer receives $563 in
ARNG FTA but departs 24 months before completion of the
four-year obligation. $563/48 = 11.73 X 24 = $282 to be
recouped.
Statement of
Understanding (SOU)
I understand and agree to reimburse or
suffer "recoupment" action for tuition paid if I
withdraw, fail, or do not complete a FTA funded course
(except for reasons beyond my control as determined by
the State Education Service Officer (ESO) or National
Guard Bureau). Additional courses will not be authorized
for FTA funding when the grades for previous coursework
have not been submitted and received by the ESO.

Recoupment Process
|
|
|
When you
applied for Federal Tuition Assistance (FTA) you signed
a "Statement of Understanding Agreements," agreeing to
the following statements:
- I understand and agree to
reimburse or suffer "recoupment" actions for
tuition paid if I withdraw, fail, or do not
complete an FTA funded course (except for reason
beyond my control as determined by the State
Education Service Officer (ESO) or National
Guard Bureau (NGB). Additional courses will not
be authorized for FTA funding when the grades
for previous coursework have not been submitted
and received by the ESO.
- I understand that I must
maintain a cumulative Grade Point Average (GPA)
of 2.0 or higher after completing 15 SH’s (or
22½ quarter hours (QH) or 240 clock hours (CH))
of TA funded college credit.
- I understand that ARNG FTA is
available to active drilling Guard members on a
first come/first serve basis. I understand it is
not a guaranteed benefit and is only available
based on federal funding.
Education
Office grade records indicate you received and "I, W, or
F" for course(s) that were paid for by the FTA Program.
NGB Policy requires the recoupment or repayment of
federal dollars paid to a university or school on a
soldier’s behalf when unsatisfactory grades are awarded.
Bottom Line:
Due to your
failure to comply with NGB Policy regarding Federal
Tuition Assistance, you have been TEMPORARILY
SUSPENDED from receiving Federal Tuition
Assistance until recoupment has been processed fully.
This suspension also applies to the State Tuition
Assistance and the UTARNG State Tuition Waiver.
Repayment
Options:
The following
two items discuss repayment and requests for "Exceptions
to Policy." If you believe extenuating circumstances
existed, which caused your unsatisfactory grades, skip
to Item B.
Option A:
NGB Policy
designates two options for repayment. They are:
- One-time or Full Payment using
the DD Form 1131, "Cash Collection Voucher."
This option
allows you to write a check for the full amount you
owe the UTARNG and mail it to the Education Office
in Draper. The check must be made out to the "US
Treasury." It will be processed by the UTARNG
USP&FO, which will notify the Education Office when
payment has been processed. Once that notification
has been received, you will have your FTA
eligibility reinstated.

- Monthly Payments using the DD
Form 139, "Pay Adjustment Authorization."
This
option allows for monthly payment to be taken
from your drill or annual training pay. It is a
debt payment that will appear on your LES. The
minimum amount allowed by the Education Office
is $25.00 per month. You are responsible for
initiating this action with your readiness NCO
or S1. Once the action is in process, you will
have your FTA eligibility reinstated. If,
however, the payment is not fully paid before
the soldier ETS’s or retires, the remaining
balance will be sought in the form of civilian
wage or tax return garnishments. Any remaining
balance will be FULLY RECOUPED.
Your
readiness NCO or S1 must inform the Education
Office that the pay action has been initiated
via email at
NGUTEducationOffice@ng.army.mil.
Your account will not be reinstated until the
Education Office receives confirmation from your
readiness NCO.
IMPORTANT: You have
180 DAYS from the end of the semester to choose
a repayment option. If you fail to choose a
repayment option, the Education Office will
submit a request for pay adjustment equal to 2/3
of your monthly drill check until the debt is
paid.
(Example: An E5 with 4 years of service earns
$321.92 on a two-day drill weekend. After the
debt payment it would only be $106.23. . .
BEFORE TAXES).
Option B:
In some
extraordinary cases NGB will grant an "Exception
to Policy," (ETP) which will extend to a soldier
relief from any recoupment payments. ETP’s have
been granted for situations such as deaths in
the family that required the soldier to quit
school, serious sicknesses or injuries for the
soldier or immediate family, divorce, PTSD or
MTBI, or voluntary/involuntary deployment. Each
ETP his handled on a case-by-case basis and not
all are granted.
NGB is
the final authority for ETP requests, however,
the State ESO is required to recommend as
soldier’s ETP to NGB. Often, the ESO will not
recommend the soldier for ETP due to lack of
effort or evidence that the situation could have
been avoided. Any ETP
request typically involves significant research
by the FTA Manager and assistant into the
validity of the request.
If you
believe your situation warrants an ETP, submit
the following documents to the Education Office

Ensure that the subject line includes your name
and semester during which you received
unsatisfactory grades. It should read as
follows: Exception to
Policy Request for SGT Smith-Fall 2009
- A formally written, typed
letter or memorandum requesting relief from
recoupment in the form of an "Exception to Policy."
You should clearly explain the background, timeline,
attempts to correct or handle the extenuating
circumstance, and any communications with the UTARNG
Education Office.
- Memorandum from the soldier’s
unit Commander detailing the soldier’s character,
performance, and the extenuating circumstance. The
commander needs to recommend the soldier for relief
from recoupment and an ETP.
The State ESO
will review both documents and assess whether or not
your situation warrants a review by the NGB Education
and Incentives Branch.
The entire ETP
process can takes months. It is essential that you be
proactive in requesting and submitting the documents to
the Education Office, as you are still ineligible for
FTA until the ETP has been granted from NGB.

Why must I payback the money that was given to me for
education?
Federal tuition assistance is a benefit, not an
entitlement. As a benefit there are certain
requirements for you to complete to ensure you are
incompliance with regulatory guidance and policy.
If you accept tuition assistance you agree to
payback any money for failed courses, un-official
withdrawals, incompletes, and withdrawals after the
add-drop deadline.
This is new, why are you now taking money from me?
Policy requires the recoupment process be
implemented when a soldier has failed to meet the
requirements of the program.
I failed a course, but I have to take it for my
degree, can't I just take the course again and pay for
it myself?
Unfortunately NO! The money was set aside
for you to complete your course. ARNG and AR
621-5 require a soldier to have a minimum
passing grade and an overall 2.0. If you drop
below either requirements you will be subject to
recoupment.
Why are you taking so much out of my Drill check each
month?
You were sent a notification letter. In the
letter you were asked to select which option you
want. You failed to respond in the 180 days
required, so the recoupment process was started.
The Army allows us to take up to 2/3rds of your
check to ensure your debt is paid back in a timely
manner.
I don't remember agreeing to recoupment for failing
my course/s.
You agreed to recoupment during your application
process. After you logged-in to IMARC
(Benefits web page), you spent some time reading the
Statement of Understanding and clicking on radio
buttons agreeing to the policy for recoupment.
You cannot continue your tuition enrollment process
unless you agree to all of the SOU requirements.
Once you agreed to the requirements you moved onto
the next window.
Is there away that I can get this waived?
There are exceptions to policy; however, they are
very limited and given for exceptional
reasons. Many people have great reasons for
needing an exception to policy, all are typically
valid in the Soldiers mind; however, leaving school
because you were deployed and failing to notify the
school in a proper manner is not an exception.
